Medicare requires you to report within 30 days any Adverse Legal Action such as convictions
What convictions are reportable?
Felonies within last 10 years that CMS “has determined to be detrimental to the best interests of the program and its beneficiaries.”
As of February 3, 2015 –This Includes ANY FELONY. CMS is supposed to consider each case individually and determine if the felony is detrimental to the program or its beneficiaries.
Misdemeanors related to: (a) the delivery of an item or service under Medicare or Medicaid, or (b) patient abuse or neglect
Misdemeanor conviction related to theft, fraud, embezzlement, breach of fiduciary duty, or other financial misconduct in connection with the delivery of a health care item or service.
Felony or misdemeanor conviction for obstruction of investigation into any criminal offense described in 42 C.F.R. Section 1001.101 (mandatory exclusion offenses)
Felony or misdemeanor conviction relating to the unlawful manufacture, distribution, prescription, or dispensing of a controlled substance.
